Breaking: Michael Flynn Case Update – Charges May Be Dropped


According to a report last week, Michael Flynn, former National Security Adviser, made headlines when he pleaded guilty to charges that he lied to the FBI. Liberals across the country were overjoyed and were quick to assume that this might be the end for President Trump. However, that might not be the case at all.

We previously reported that FBI operative Peter Strzok was fired after allegations surfaced that he held and acted on biases against Trump. This was disturbing given the fact that Strzok played a key role in several investigations with the potential to directly or indirectly impact Trump, his campaign or his presidency. Now, it’s been revealed that Strzok’s firing may throw a wrench in the plan of prosecutors who are hoping to punish Flynn for incorrectly remembering the events that took place during the Trump transition.

On his blog Instapundit, law professor and USA Today columnist Glenn Reynolds outlined the case of why a judge is likely going to be forced to drop the charges against Flynn. He explained that the case against Flynn was flawed because Trump’s former staffer wasn’t ever informed of the bias from Strzok, which is a clear Giglio violation.

A Giglio violation refers to the Supreme Court case Giglio versus United States, in which the Court held that the prosecution’s failure to inform the jury that a witness had been promised not to be prosecuted in exchange for his testimony was a failure to fulfill the duty to present all material evidence to the jury, and constituted a violation of due process, requiring a new trial.

We now know that Strzok’s interview with Flynn was carried out under false pretenses, as Flynn thought Strzok was meeting with him over security training for the transition. Because of this, Flynn never asked for his attorney to be present, and ended up making false or misleading statements that led to his being charged.

The left was hoping that this would take President Trump down. However, they are in for a huge disappointment.
